1. Agreement to Terms

By accessing or using TradeBinder ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, traders, collectors, and contributors of content.

2. Eligibility and Age Requirements

To use TradeBinder, you must:

• Be at least 13 years old (or the age of majority in your jurisdiction, whichever is higher)
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the Service under applicable laws

Important: Users under 18 years of age must have parental or guardian permission to use the Service, especially when engaging in trades that involve:

• Meeting in person with other users
• Shipping physical items
• Exchanging items of value

By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 User Verification

TradeBinder may require user verification for certain features, including the ability to send trade offers. Verification helps ensure the safety and integrity of our trading community. We reserve the right to verify user identity through reasonable means and to restrict or suspend accounts that fail verification or engage in suspicious activity.

3.3 Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Use of the Service

4.1 Permitted Use

You may use TradeBinder to:

• Track your Pokemon card collection
• Create and manage trade profiles
• Make and receive trade offers
• Connect with other collectors for trading purposes
• Access pricing and market data (subject to your subscription tier)

4.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Harass, abuse, threaten, or harm other users
• Post false, misleading, or fraudulent information
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated systems (bots, scrapers) to access the Service without permission
• Interfere with or disrupt the Service or servers connected to the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to compete with TradeBinder or build a similar service
• Resell or redistribute any data obtained from the Service (except as permitted by your subscription tier)
• Violate any applicable local, state, national, or international law

5. Trading and Transactions

5.1 TradeBinder is a Platform, Not a Party to Trades

Important: TradeBinder is a platform that facilitates connections between collectors. We are NOT a party to any trades or transactions between users. We do not:

• Own, buy, sell, or handle any cards or items traded through the Service
• Guarantee the authenticity, condition, or value of any items
• Process payments between users
• Provide escrow services
• Mediate disputes between users
• Assume liability for trades that go wrong

5.2 Your Responsibility for Trades

You are solely responsible for:

• Verifying the authenticity and condition of items before trading
• Negotiating the terms of each trade (including shipping, payment, meetup details)
• Completing trades in a timely and honest manner
• Resolving disputes with other users
• Complying with all applicable laws regarding trading, shipping, and sales
• Your safety when meeting in person with other users

5.3 In-Person Meetups

If you choose to meet in person with another user, you do so at your own risk. We recommend:

• Meeting in public, well-lit locations
• Bringing a friend or family member if possible
• Verifying the other user's identity before meeting
• Informing someone you trust about your meeting plans
• Trusting your instincts and leaving if you feel unsafe

TradeBinder is not responsible for any harm, loss, or damage that occurs during in-person meetups.

5.4 Shipping

If you choose to ship items, you are responsible for:

• Properly packaging items to prevent damage
• Obtaining appropriate insurance and tracking
• Complying with shipping regulations and restrictions
• Any shipping costs and fees

5.5 Prohibited Items

You may not trade or offer to trade:

• Counterfeit or fake cards
• Stolen items
• Items that violate intellectual property rights
• Any items prohibited by law

6. Subscriptions and Payments

6.1 Subscription Tiers

TradeBinder offers the following subscription tiers:

• Trainer (Free): Limited features, up to 200 cards
• Gym Leader (Pro): $7/month - Unlimited cards, public trade profile, price alerts
• Champion (Elite): $29/month - All Pro features plus API access and MCP integration

6.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method automatically on a recurring basis until you cancel.

6.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until the end of the period you've already paid for.

We offer a 14-day money-back guarantee for new subscriptions. Refund requests must be made within 14 days of your initial subscription purchase. Contact support@tradebinder.gg for refund requests.

6.4 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' notice of any price increases. Price changes will apply to your next billing cycle after the notice period.

7. API Access (Elite Tier)

7.1 API Usage Limits

Elite tier subscriptions include 10,000 API calls per month. Additional calls may be purchased at $5 per 5,000 calls. We reserve the right to enforce rate limits and suspend API access for abuse.

7.2 API Key Security

You are responsible for keeping your API keys secure. Do not share your API keys or commit them to public repositories. We are not responsible for any unauthorized use of your API keys.

7.3 API Restrictions

You may not use the API to:

• Build a competing service
• Resell or redistribute data obtained through the API
• Make excessive requests that could harm the Service
• Scrape or download large portions of our database

8. Intellectual Property

8.1 Our Content

The Service, including its original content, features, and functionality, is owned by TradeBinder and protected by international copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain ownership of any content you submit to the Service (collection data, trade descriptions, profile information). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, display, and distribute your content for the purpose of operating and providing the Service
• Share your wishlist and wanted card data with vendors, card shops, and other partners who may be able to help you find the cards you're looking for

8.3 Card Images and Data

Card images and metadata are provided by third-party sources (TCGdex, TCGPlayer). These are used under license and remain the property of their respective owners.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

We strive to provide reliable service but do not guarantee that the Service will be available at all times, uninterrupted, or error-free. We may experience downtime for maintenance, updates, or unforeseen circumstances.

9.2 Price Data Accuracy

We provide price data from third-party sources (TCGPlayer, PriceCharting). While we strive for accuracy, we do not guarantee that price information is current, accurate, or complete. Prices are estimates based on market data and should not be considered definitive valuations.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADEBINDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any trades or transactions between users
• Any unauthorized access to or use of our servers or your account
• Any errors or omissions in any content
• Any loss or damage of any kind incurred as a result of your use of the Service

9.4 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify, defend, and hold harmless TradeBinder and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Any trades or transactions you engage in through the Service

11. Dispute Resolution

If you have a dispute with another user, you are responsible for resolving it directly with that user. TradeBinder is not obligated to mediate disputes but may, at our discretion, provide tools or information to help resolve issues.

For disputes with TradeBinder, you agree to first contact us at support@tradebinder.gg to attempt to resolve the dispute informally.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using the Service and may delete your account.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by deleting it through your account settings.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TradeBinder operates, without regard to its conflict of law provisions.
